Saish Terms of Service

These terms are the agreement between you and Caleb Wilson ("we", "us"), the developer of Saish, for your use of the app. By using Saish, you accept them. They're written to be read, not to be got around — if anything here is unclear, email us and we'll explain it.


1. What Saish is

Saish is an app for mixing ambient sound, resting and sleeping. It plays sound, keeps your mixes, and can run timers and alarms.

It is not a medical device and not medical advice. It doesn't diagnose, treat or prevent anything, including any sleep condition. If you're worried about your sleep or your health, speak to a doctor.

Don't rely on it for anything that matters if it fails. Alarms and timers depend on iOS, on your device staying on and charged, and on nothing else interrupting audio. Use a dedicated alarm for anything you must not miss.

Don't use it while driving or operating machinery, and don't use it at a volume that stops you hearing what's going on around you. Please look after your hearing: long listening at high volume can damage it.

2. Who can use it

You need to be 13 or older, or the minimum age where you live if that's higher. If you're under 18, a parent or guardian should agree to these terms with you.

3. Free use and subscriptions

Saish is free to try for a set number of listening sessions. After that, some features need a subscription.

4. What you can and can't do

You may use Saish for your own personal listening, on the devices your Apple Account allows.

You may not:

Sound Requests. When you send a suggestion, you let us read it, act on it, and make what it asks for. Don't send anything personal or confidential — see the Privacy Policy for what happens to it.

5. Who owns what

The app, its sounds, its artwork and its written content belong to us or to the people we licensed them from. These terms give you permission to use the app, and nothing more.

Your mixes are yours. They're stored on your device and, if you use iCloud, in your own iCloud account.

6. Apple Music and Spotify

Saish can play alongside Apple Music or Spotify, which remain separate services with their own terms and their own subscriptions. Both are controlled by their own apps: we can't change their volume, and we're not responsible for what they play, whether they're available, or what they charge. You need your own account with them.

7. Availability and changes

We may update, change or stop parts of the app. Sounds and written content are downloaded from our servers, and we can't promise those will always be reachable. If we stop the app altogether, we'll say so in it beforehand where we reasonably can.

8. Our responsibility, and its limits

We provide Saish with reasonable care and skill. Beyond that, and as far as the law allows, it's provided as it is, without any other guarantee — we don't promise it will be uninterrupted, error-free, or that it will help you sleep.

We are not liable for anything we couldn't reasonably have foreseen, for lost sleep, missed alarms, lost data, or for any loss caused by using the app in a way these terms tell you not to.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law won't let us limit. If you're a consumer, you keep all your legal rights as one, and nothing here takes those away.

Where liability can be limited, ours is limited to the amount you paid us for the app in the twelve months before the problem arose.

9. Ending this agreement

You can stop using Saish at any time by deleting it. Cancelling a subscription is separate, and is done through Apple as described above.

We may end your access if you break these terms — in practice, only for something serious, and we'll tell you why.

10. Changes to these terms

If we change these terms, we'll update the date at the top, and tell you in the app if the change is significant. Carrying on using the app after that means you accept the new terms.

11. Law

These terms are governed by the law of England and Wales, and disputes may be brought in its courts. If you're a consumer living elsewhere, you keep the rights and protections of your own country's law and can bring a claim there.
